    ART & Surrogacy

    • Date : 18/12/2021 -

The Assisted Reproductive Technology (Regulation) Act and the Surrogacy (Regulation) Act in India have been established to regulate the growing field of assisted reproductive technology and surrogacy arrangements in the country. These acts aim to protect the rights of intended parents, surrogate mothers, and children born through assisted reproductive techniques.

Under the ART Act, clinics and healthcare facilities offering assisted reproductive technology services must be registered and adhere to strict guidelines to ensure the safety and well-being of all parties involved. The act also addresses issues such as consent, confidentiality, and the handling of genetic material.

Similarly, the Surrogacy Act prohibits commercial surrogacy and only allows altruistic surrogacy arrangements in India. This means that a surrogate mother cannot be paid for carrying a child, but can only be reimbursed for medical expenses and other related costs. The act also outlines the eligibility criteria for intended parents and surrogate mothers, as well as the legal rights and responsibilities of all parties involved.

Both acts serve to promote ethical practices in the field of assisted reproductive technology and surrogacy, while also safeguarding the interests of all individuals involved in these processes.
